Be wary of prescription scams
A longtime reader who has all of her faculties wants to sound the alarm on a financial scam that preys on the elderly.
Two days before the Medicare prescription drug plan deadline this month, she got a call from someone who wanted to get her signed up for a plan. She hadn't signed up yet because her prescriptions were affordable.
The offer was from "the biggest insurance company in New York," according to the telemarketer. Our reader thought the government was so far behind in getting folks signed up that it turned to foreign workers to get it done. "I kind of felt sorry for them," she said.
The caller turned up the nice level and convinced her to get on their plan. All they needed was her Social Security number and some bank account information so they could draft a $377 start-up fee.
She got suspicious and immediately got to her bank to stop any such transaction. She alerted the police and her congressman and now she wants to alert her fellow central Oklahoma residents.

Avoid ADHD drugs, Canada tells heart patients
Canada's health ministry on Friday warned people with high blood pressure, heart disease and a number of other medical ailments not to take drugs used to manage Attention Deficit Hyperactivity Disorder (ADHD). Health Canada said that in rare cases, people with these conditions who took the drugs could suffer "rare heart-related side effects." In a statement, it warned people not to give up the drugs before consulting their doctor. Millions take the drugs to treat attention deficit hyperactivity disorder, which causes trouble with focus as well as hyperactivity and impulsiveness. "All ADHD drugs stimulate the heart and blood vessels ... The effects are usually mild or moderate, but in some patients this stimulation may -- in rare cases -- result in cardiac arrests, strokes or death," said Health Canada. The drugs should be shunned by those with high blood pressure, heart disease or abnormalities, hardening of the arteries or those with an overactive thyroid gland, it added. Reviewers at the U.S. Food and Drug Administration (FDA) have been working for months to analyze reports of sudden deaths, heart attacks and strokes as well as psychotic behavior such as hallucinations suffered by those who took the drugs. In March, a panel of U.S. medical advisors called for new information about heart risks to be added to labeling for ADHD medications but stopped short of recommending tougher measures. Compound drugs outside FDA scope
The drug-compounding industry scored a major victory this week as a federal court ruled compounded drugs are outside U.S. FDA reach. A federal district court in Midland, Texas, held Thursday that compounded preparations are not "new, unapproved drugs," according to a statement issued Friday by the non-profit group International Academy of Compounding Pharmacists. The decision spares drug-compounding pharmacies from having to meet strict Food and Drug Administration regulations on drug safety and efficacy before they can market their products. "This landmark ruling stops the FDA's encroachment on the authority of state boards of pharmacy in its tracks and it ensures that patients and physicians will continue to have access to compounded medicines on which they rely," said L.D. King, IACP's executive director. "For years, FDA told pharmacists that what they were doing -- compounding medicines to fill doctors' prescriptions -- was illegal," the group said. "This ruling lifts the veil of uncertainty from pharmacy compounding and once again allows pharmacists to serve their patients confidently. That the judge ruled from the bench shows us just how strong the plaintiffs' case was." However, two other issues still remain before the court: the scope of the FDA's authority to inspect pharmacies' records and the pharmacies' ability to compound using bulk active ingredients for the manufacture of drugs not intended for food animals, including treatments for companion animals and zoo animals. The case -- Medical Center Pharmacy, et al. vs. Gonzalez -- was originally filed by nine pharmacies in September 2004. Prescription plan causing pain for some seniors
Main Line seniors racing to make the May 15 Medicare Prescription Drug Plan deadline faced several confused months trying to figure out which of the more than 50 plans would be right for them. Groups Call for Outlawing Of Prescription Drug Ads
A coalition of health-related and senior citizens organizations is launching a new campaign for legislation to ban pharmaceutical companies from advertising drugs directly to consumers. The effort to ban the ads is being led by an anti-advertising organization founded by Ralph Nader, Commercial Alert, and a group promoting "social justice" in the health care system, the National Women's Health Network. "Prohibition, that's what's best for public health," the executive director of Commercial Alert, Gary Ruskin, said in an interview. In a statement, he called the ads "dishonest and dangerous" and said they have increased the damage done by drugs with harmful side effects. Mr. Ruskin said the ads encourage patients to demand prescriptions from physicians for drugs that may be ineffective or even dangerous. More than 200 physicians at prominent medical schools have announced support for an advertising ban. Mr. Ruskin has drafted legislation, dubbed the Public Health Protection Act, which has won the endorsement of 39 organizations. He said efforts to find a congressional sponsor have just begun. "First, you build the legislative coalition, then you start to find somebody who will introduce it," he said. A trade group for the drug industry said yesterday that prohibiting such ads, which are ubiquitous on television, would be ill advised. "A ban on the advertising of prescription medicines would hurt patients' ability to learn about new medicines in a timely fashion and does not advance quality health care," a senior vice president at the Pharmaceutical Research and Manufacturers of America, Ken Johnson, said in a statement. So-called direct-to-consumer advertising "empowers patients, increasing people's awareness of diseases and available treatments," he said. An attorney with a pro-business legal advocacy group, the Washington Legal Foundation, charged that the proposal violates the First Amendment. "Very clearly, it's unconstitutional," the lawyer, Richard Samp, said. "The opponents of advertising essentially are saying let's stop advertising because too much truth and information is bad for people.... The Supreme Court absolutely rejected that rationale." Mr. Ruskin conceded that an outright ban on drug advertising may not pass muster in the courts. He said that's why he included fallback provisions in the proposed legislation that would take away federal tax deductions for such ads, require new disclaimers, and impose a 3% windfall profits tax on drug companies. "The constitutionality of a ban on direct-to-consumer prescription drug advertising is unclear, so because of that we need to have a backup," the anti-advertising activist said. "As advocates we have to advocate for the best public health solution.... Funding Boost for Research Into TB And Malaria Drugs
Efforts to improve health in developing nations received a boost this week with news of major funding to find faster-acting tuberculosis drugs, and a new partnership aiming to develop the next generation of malaria drugs. The Bill and Melinda Gates Foundation is providing US$104 million for the TB research, according to an announcement made today (25 May) by the TB Alliance, a public-private partnership that will undertake the work. Multi-drug resistant forms of the TB bacterium are more likely to emerge if patients do not complete their treatment or if their drug supply is interrupted. Gates Foundation gives $104 million for TB drugs
Tuberculosis, one of the world's biggest killers, is spreading globally and gaining in virulence as some strains are learning to evolve into almost bullet-proof bugs dubbed "XDR-TB." The X stands for "extreme" and often translates into an incurable, deadly disease. "We desperately need better and faster-acting drugs for TB," said Dr. Peter Small, head of the tuberculosis program at the Seattle-based Bill & Melinda Gates Foundation. To assist in this increasingly desperate endeavor, the Seattle philanthropy today announced that it has given $104 million to a non-profit, international organization called the Global Alliance for TB Drug Development (or, more commonly, the TB Alliance). "When we formed about five years ago, there was not a single TB drug in the (research and development) pipeline," said Maria Freire, president of the TB Alliance. The organization has offices in New York, Brussels and Cape Town, South Africa. Today, partly due to the first $25 million the Gates Foundation donated in February 2000 to help launch the initiative, Freire said the group and its partners have two new TB drugs in clinical trials and nine other candidate drugs under development. The new Gates grant, she said, will help bring one of the new antibiotic drugs called moxifloxacin through phase 2 studies and into the large-scale phase 3 clinical tests needed before it can be widely distributed. Made by Bayer Healthcare, this antibiotic could significantly reduce the treatment time required to cure patients, experts believe. "One of the key problems with the treatment is simply the length of time it takes to work," said Dr. Jaime Bayona, director of Socios en Salud (Partners in Health), a TB-focused program in Peru affiliated with Harvard University and the world-renowned health advocate Dr. Paul Farmer. Druggists ask for help to speed Medicare pay
Merlin McFarland said he wants to continue serving seniors at his Wichita drugstore, but the Medicare prescription drug program is making it tougher for him and other small pharmacists to stay in business. McFarland owns Professional Pharmacy on North Waco along with drugstores in Cheney and Kingman. He took out an extra $200,000 line of credit to cover costs at the beginning of this year, thinking he would need extra cash in reserve while insurance companies switched to new reimbursement systems under the new drug program. The credit was exhausted by the end of January. The disruption brought McFarland to Washington on Tuesday, where druggists met with lawmakers about what to do about slow insurance payments they say are hurting their businesses. Reps. Jerry Moran, R-Hays, and Dennis Moore, D-Lenexa, called for lawmakers to support a bill requiring speedier payments. "The only thing that's worse than not getting paid to cover your costs is to not be paid at all," Moran said. "That's what we're experiencing." Drug and insurance companies say that while the new drug benefit has had its bumps, pharmacists' fears are exaggerated. Any changes made "should be between plans and pharmacies, not micromanaged by the government," said Mark Merritt, president of the Pharmaceutical Care Management Association. The Medicare prescription drug plan has faced criticism since full implementation began this year. About 43 million seniors nationwide are eligible for the plan. By the May 15 deadline for signing up without a penalty, the Bush administration said that up to 90 percent of those seniors had prescription drug coverage, either through Medicare or other plans. Critics think that estimate is optimistic. They maintain that the program is confusing to seniors and cumbersome for health care providers. McFarland said that before the new benefit's bureaucracy took over, it would take about a week to receive an insurance company payment. Now, it's 30 to 35 days. That has put a crunch on him and other pharmacists, especially those who own smaller, independent drugstores. "Basically, I now have to have enough cash available to cover 30 days of sales," he said. That makes business more difficult, especially at the Wichita pharmacy, which has more senior-citizen customers, he said. Moran and Moore, who both voted against the Medicare drug bill, and Rep. Todd Tiahrt, R-Goddard, who voted for it, all said they support the pharmacy fix. A bill that Moran and Moore are co-sponsoring would require Medicare drug plan providers to offer electronic direct deposit of reimbursements to participating pharmacies. It would then require electronic claims to be paid within 14 days, and all other claims within 30 days. It also tries to raise profit margins for generic drugs, which small pharmacists say they need so they can keep providing them. Getting the legislation approved is far from certain. Merritt, whose association has ties with drug and insurance companies, said before a congressional subcommittee Tuesday that plans to mandate quicker payments would increase costs to taxpayers and consumers. A 30-day payment cycle is standard in the health care industry, he said. With the prescription drug benefit just starting, many in Congress are reluctant to change it until its consequences are fully understood. Moran said that may be too late. County’s prescription program going well
CLARION -- Area pharmacists say the prescription discount card program offered through the National Association of Counties is serving Clarion County residents well. "It has made a difference," said CVS Pharmacist Amy Fagan. Fagan said since January, CVS has filled 231 prescriptions for people using the cards. Other pharmacists like Eric Conti of Kmart said they don't have an exact count on the number of prescriptions they've filled for customers using the cards but are certain people are taking advantage of the savings. "Customers are happy with it," said Klingensmith's Drug Store Pharmacist Denny Smith. Smith said it enables customers without insurance to at least get medications at a discount. The discounts vary from medication to medication, explained Marianne Pharmacy Pharmacist Stephanie Sigel, but "it's been working." Fagan said she also recommends the discount cards in cases when a person has insurance but their coverage does not include a particular drug. "I would rather see our patients have more affordable drugs," Fagan said. Fagan said customers also have been taking advantage of the cards for their pet's medications. Fagan said in rural areas pet insurance is not common. Pharmacists also said they have no concerns with the program. Fagan said to prevent people from other counties trying to obtain the cards, CVS employees verify the customer's address. Clarion County commissioners decided to renew the county's membership with NACo in 2006 for about $860 so residents could benefit from the program, said Clarion County Commissioner Donna Hartle. NACo reports the average discount per prescription is about $12.88. Caremark administers the prescription drug discount card program. " Clarion County is proud to be one of the counties nationwide participating with NACo," the Clarion County commissioners said. "The NACo prescription discount card offers significant savings for the uninsured and underinsured residents of our county, and even those fortunate to have prescription coverage can use the card to save money on drugs that are not covered by their health plan. TRICARE ALTERS PRESCRIPTION REGS FOR FLOODED AREAS
Prescription refill regulations have been relaxed for TRICARE participants in three flooded states. The TRICARE Management Activity administers the military health care system, TRICARE. Retroactive to May 16, TRICARE Management is allowing beneficiaries to refill their prescriptions "as needed" in New Hampshire, Massachusetts and York County, Maine. The areas have been declared disaster areas by their respective governors. Normally, participants are only allowed to refill prescriptions when 75 percent of the medicine has been used.
